Our Promise to You

This Privacy Policy describes how Xi'an Fengyu Information Technology Co., Ltd. and its affiliates (hereinafter referred to as "Fengyu" or "We") collect, use, disclose, process, and safeguard the information you provide to us when using our products or services. If We ask you to provide certain information in order to verify your identity when using Fengyu products or services, we will use this information in strict accordance with this Privacy Policy and/or our User Terms and Conditions.

This Privacy Policy was formulated to fully take your needs into account. It is important that you fully understand our personal data collection and usage practices and feel confident in your ability to control the personal information you provide to Fengyu.

In this Privacy Policy, "personal information" refers to data, either derived from information itself or from other related personal information that Fengyu is able to access, that can distinguish a specific individual.

By using Fengyu products and services, it shall indicate that you have read, acknowledged, and accepted all terms found in this Privacy Policy and any changes we may introduce at any time. We pledge to protect the privacy, confidentiality, and safety of your personal information by following applicable laws (including your local data protection laws). At the same time, we also promise that our staff and agents will fulfill these obligations.

Lastly, we would like to give our users the best experience possible. Which types of information are collected and how are they used?

Types of Information Collected

When providing you with services, we will ask you for personal information that is necessary for us to successfully provide those services. If you do not provide us with this personal information, we may not be able to provide our products or services to you.

We collect the following types of information (regardless of whether or not they are considered to be personal information):

  • 1) Information that is related to you:When you log in with your Mi account or WeChat account, we will collect and use the open ID of your Mi account or WeChat account to generate your Fengyu account as an identity authentication tool to log in Mi Walkie-Talkie. After you log in, we may acquire an OAuth token that you have authorized to synchronize your personal ID, avatar, nickname, and gender information. When you use the Location Sharing feature, show your friends as your personal information. If you want to cancel your Fengyu account, you can send a message to privacy@ifengyu.com, we will cancel your account after verifying your identity.
  • 2) Information you provided to us or uploaded (including your contact information): We may collect the phone number and email address that you have provided us with. Phone numbers and email addresses are optional and are used to contact you when the software license agreement or privacy policy changes. If you choose not to fill it in, then we will not collect it. You can delete your phone number and email address in the app, and the server will also delete your information at the same time.
  • 3) Location and channel information: When you use features like Location Sharing, Ranging, Altitude, Latitude and Longitude, we will collect and use your latitude and longitude information and altitude information. Sometimes we will collect latitude and longitude information and altitude information for your location sharing friends (only when you enabled location sharing), and the channel used by the current walkie-talkie. Such information is stored in the mobile phone cache and the walkie-talkie cache. If you need to delete the stored information, you can do the following:

    • i. Android: Clear all data or uninstall Mi Walkie-Talkie; iOS: Uninstall Mi Walkie-Talkie

    ii. Restart Walkie-talkie or Restore Factory Settings

    Delete the information stored in the mobile phone cache and the walkie-talkie cache separately.

  • 4) Track information (only for exercise track recording): When you use the motion track recording function, we collect your starting position, ending position, start time, end time, total distance, speed, altitude, latitude and longitude to show you your movements. You can delete the relevant exercise track information in the app to permanently delete information.
  • 5) Walkie-talkie device information: We may collect your walkie-talkie device attribute, activation status and board ID, firmware version number to activate the walkie-talkie, implement firmware upgrades, and enable you to operate your walkie-talkie through the app. If you need to delete the stored information, you can do the following:

    • i. Android: Clear all data or uninstall Mi Walkie-Talkie; iOS: Uninstall Mi Walkie-Talkie

    ii. Send a message to privacy@ifengyu.com, we will delete your information after verifying your identity.

  • 6) User feedback: If you have any comments or suggestions, you can submit your feedback in the app. We will collect the feedback from you. If you choose to leave your contact information, we will also collect your contact information and contact you if necessary to get more information about your comments or suggestions.You can delete your feedback and contact information from the app, and the server will also delete your information at the same time.
  • 7) We may also collect other types of anonymous information that are not associated with individuals. For example, model information, system version, provider information, voice information, region information, app version, resolution and network environment information. The purpose of collecting such information is to make the "Mi Walkie-Talkie" app adapt to each model better, and to improve the user experience by counting the usage of the user group.

How this personal information Is used?

The purpose of collecting personal information is to provide you with products and/or services while also ensuring that we comply with applicable laws. You hereby agree to our processing of personal information in accordance with the purposes stipulated by this Privacy Policy, and you agree to disclose personal information to our affiliates (involving communications, social media, technologies, or cloud services) and to third-party service providers (as defined below).

We may use your personal information for the following purposes:

  • To provide, process, maintain, improve, and develop the products and/or services we offer, including after-sales service and customer support, as well as services provided through your device or the website.
  • Communicate with you regarding your device, services, or any other common queries (including updates, customer support, information related to our activities, and notifications).
  • Conduct relevant promotional activities, such as providing promotions, marketing materials and updates. For more information on promotion and marketing activities, please refer to the Direct Promotion section below.
  • Analysis and development of statistical information related to the use of our products and services that is used to further improve our products and services.
  • Storage and maintenance of your information, to be used in our business operations or to fulfill legal obligations.
  • Send notifications. We may occasionally use your personal information to send important notifications, for example, notifications about changes to the communications of items you have purchased, our terms, conditions, and policies.

  • 6） Collect the mobile phone system information of the user group, adapt to different systems, ensure functional integrity and an enjoyable experience.

Direct Promotion

  • We may use your name, phone number, email address and Mi account provided, to provide you with relevant promotional materials for products and services of the Fengyu Corporation and its partners. We will strictly adhere to your local data protection laws and seek your independent, explicit permission to use your personal information. We will only use your personal information when we have your consent, or you have expressed that you do not object to us using your personal information. You have the right to terminate our use of your personal data for planned direct promotions. If you do not wish to receive certain types of emails any longer, you can unsubscribe to such emails via the unsubscribe link at the bottom of each email, or send a message to privacy@ifengyu.comfor cancellation. We will never send your personal information to our business partners for direct promotions.

Who do We share your information with?

We will not sell any of your personal information to a third party.

At times, we may disclose your personal information to a third party (as defined below) in order to provide products or services that you have requested.

We may disclose your personal information to third-party service providers and affiliated companies as listed below. In each scenario listed below, you can rest assured that Fengyu will only share your personal information according to what you have personally authorized. You should understand that when Fengyu and third-party service providers are sharing your personal information in each scenario listed below that Fengyu shall stipulate practices and obligations of such third parties via contracts to comply with applicable local data protection laws. Fengyu shall also use contracts to ensure that third-party service providers comply with standards of privacy rights applicable to them in your jurisdiction.

Sharing Information with Third-party Service Providers

In order to operate successfully and provide you with the full functionality of our products and services, we may occasionally disclose your personal information to other Xaiomi affiliates or with our third-party service providers (our delivery services providers, telecommunications companies, data centers, data storage facilities, customer service providers, and agents representing Fengyu). These kinds of third-party service providers may process your personal information as a representative of Fengyu, or they may fall into one or several of the categories listed above. If you would like us to stop sharing this information, please contact us by sending an email to privacy@ifengyu.com.

Sharing Information with Companies in the Xiaomi Ecosystem

Xiaomi cooperates with a group of cool companies and they jointly constitute the Xiaomi Ecosystem. As an independent entity invested in and operated by Xiaomi, the Xiaomi Ecosystem Company is truly an expert in these domains. To provide you with and improve the exciting products and services of the Xiaomi Ecosystem Company (which include software and hardware), Fengyu may disclose your personal information to the Company. Xiaomi brands may be used for some products and services, while for other products, Fengyu may use its own brand. From time to time, we may share data related to products and services provided under Xiaomi brands with Xiaomi, in order to provide software and hardware services, and offer better features and user experience. If Fengyu is involved in any merger, acquisition, or sells all or part of its assets, we will use emails and/or eye-catching notices on our websites to inform you any changes of ownership or use of your personal information, and any options you may have regarding your personal information.

Sharing Information with Others

Fengyu may disclose your personal information to others without further consent when it is required by law.

Information that Does Not Require Consent

  • We may share anonymous information in aggregate form with third parties (such as advertisers on our website) for commercial purposes. We may share common usage trends of our services, for example, the number of customers in a particular group who purchase certain products or engage in certain transactions.
  • In order to avoid any suspicion, Fengyu may collect, use, or disclose your personal information without your consent when expressly permitted by local data protection law (to, for example, comply with a subpoena). We may also disclose your information without your consent if We believe in good faith that it must be disclosed in order to protect our rights, your safety, or the safety of others; investigate fraud; or respond to government requests.

Fengyu's Security Measures

We are committed to keeping your personal information secure. In order to prevent unauthorized access, disclosure, or other such risks, we have implemented reasonable physical, electronic, and management-related measures to protect the information we collect from your mobile devices and Fengyu website. We will take all reasonable measures to protect your personal information.

Your personal information is all stored on safe servers and is protected in controlled facilities. We will classify your data based on importance and sensitivity and ensure that your personal data possesses the highest level of security. We will ensure that staff and third-party service providers which access such information to help provide you with services and products shoulder the strict contractual obligation of maintaining confidentiality. If they fail to fulfill such obligations, then we will impose disciplinary actions or terminate cooperation. In short, we will periodically review information collection, storage, and handing practices, including physical security measures, to prevent any unauthorized access and use.

We will take all possible measures to protect your personal information. You should, however, be aware that the Internet is not always secure. Because of this, we cannot guarantee the security or integrity of any personal information when it is being transmitted online in either direction.

What you can do

  • You can ensure that your personal information remains protected by not revealing your login password or account information to anyone (unless you formally authorize them).
  • Fengyu is not responsible for security oversights caused by third-party access of your information due to your failure to ensure the privacy of your own personal information. Despite the above regulations, you must immediately notify us if any online users access your account without permission or if any other security breaches occur.
  • Your assistance will help us better protect the privacy of your personal information.

Retention Policy

We will retain personal information if necessary for fulfilling the purpose for which it was collected or for complying with applicable legal requirements or permissions. As long as we can reasonably infer that a retention of personal information cannot fulfill the purpose for which it was collected, and we no longer need to retain the information for legal reasons, dispute resolution, enforcement of our agreements, or any other business-related purpose, we will cease to retain such personal information, or we will eliminate any ways in which such personal information may be associated with specific individuals.

Accessing Other Features on Your Device

Our applications may access some features on your devices, like Wi-Fi network state, and other features. Such information is used to allow running of those applications on your devices and your interactions with our applications. You can turn off such applications at the device-level or contact us at privacy@ifengyu.com to revoke permissions at any time.

You have control over your information!

Control Settings

Fengyu is fully aware that everyone has different concerns about privacy. Therefore, we have provided some examples of the various ways in which Fengyu allows you to limit the collection, use, disclosure, and processing of your personal information, in addition to ways in which you can control your privacy settings:

  • Turn on/off the user experience program
  • Log in/out your Mi account or WeChat account
  • Turn on/off services and features that involve sensitive or personal information, such as location sharing, track recording

If you previously agreed to let us use your personal information for the purposes described above, you can change your decision at any time by sending an email to privacy@ifengyu.com, and we will remove the related information after verifying your identity.

Accessing, updating, or correcting your personal information

  • You have the right to request access to and/or correct any personal information we have about you. When you update your personal information, you will be asked to verify your identity before your request is processed. Once we have a sufficient amount of information, we will be able to process your request to either access or make corrections to personal information. We will respond to your request within the period specified by applicable data protection laws.
  • We normally provide these services free of charge, but we reserve the right to charge a reasonable fee for requests to access data.
  • If you wish to submit a request to access personal data we have about you, or if you believe that any information we have about you is incorrect or incomplete, please write us a letter or send an email to the address provided below as soon as possible. Email: privacy@ifengyu.com.

Revoking Consent

  • You may submit a request to withdraw your consent for us to collect, use and/or disclose any of your personal information that we have or control. You may send messages to privacy@ifengyu.com and proceed the operations. We will process your submission within a reasonable amount of time, after which, we will abide by your request and no longer collect, use, and/or disclose your personal information.
  • Please note that your revocation of consent may result in some legal consequences. Based on the extent to which you decide to revoke consent for us to process your personal information, you may no longer be able to enjoy the use of the Fengyu products and services.

Transfer of Personal Information to Regions Outside Your Jurisdiction

If we need to transfer personal information outside the region of legal jurisdiction where you are, whether to our affiliates or to third-party service providers, we will comply with applicable laws, fully inform you and proceed with your authorization. We will implement appropriate security safeguards in order to ensure that all such transfers comply with applicable local data protection laws. And we will not change our commitment to protect your personal information by complying with this Privacy Policy.

Additional regulations

Minors

  • We believe that it is the responsibility of parents to supervise their children when using our products and services. Our policy, however, does not require the obtainment of personal information of minors or the sending of any promotional materials to minors.
  • Fengyu will not seek or attempt to seek any way to obtain personal information from a minor. If parents or guardians have reason to believe that a minor has submitted personal information to Fengyu without their prior consent, they should contact us at privacy@ifengyu.com to ensure that such personal information is removed and that subscriptions the minor may have for any applicable Fengyu services are canceled.

Order of Priority

If you have agreed to an applicable user agreement and there is any inconsistency between said agreement and this Privacy Policy, such user agreement shall have precedence.

Privacy Policy Updates

We keep our Privacy Policy under regular review and may update this privacy policy to reflect changes to our information practices. If we make material changes to our Privacy Policy, we will notify you by email (sent to the email address specified in your account) or post the changes on all the Fengyu websites or notify you through your mobile device, so that you may be aware of the information we collect and how we use it. Such changes to our Privacy Policy shall apply from the effective date as set out in the notice or on the website. We encourage you to periodically review this page for the latest information on our privacy practices. Your continued use of products and services on the websites, mobile phones and/or any other device will be considered as acceptance of the updated Privacy Policy. We will seek consent from you again before we collect more personal information from you or when we wish to use or disclose your personal information for new purposes.

Do I have to agree to all terms and conditions of third parties?

Our Privacy Policy does not apply to products and services offered by a third party. Fengyu products and services may include third party products, services, and links to third party websites, such as the standard map and satellite map provided by AMAP, and the standard map and satellite map provided by Google When you use such products or services, they may collect your information too. For this reason, we strongly suggest that you read the third party’s privacy policy just as you have taken the time to read ours. We are not responsible for and cannot control how third parties use personal information which they collect from you. Our Privacy Policy does not apply to other websites that are linked to through our services.
